PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE ROSTO WEBSITE, PLACING AN ORDER, OR USING ANY OF OUR SERVICES. BY ACCESSING OUR WEBSITE OR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "Customer") and Rosto, a brand operated by Cure Companies ("Rosto," "we," "us," or "our"), governing your access to and use of the Rosto website (www.rostochicken.com), online ordering platform, loyalty program, catering services, and in-store dining experiences (collectively, the "Services").
By using our Services, you represent that you are at least 18 years of age, or are using the Services under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into a binding agreement.

These Terms apply to all interactions with Rosto whether in-person, online, or through third-party platforms authorized by Rosto.
3. Our Services
Rosto offers the following services, each subject to these Terms:
3.1 In-Store Dining
When dining at Rosto, you agree to comply with our posted in-store policies, including but not limited to applicable health and safety requirements, dress codes, and conduct standards. We reserve the right to refuse service to any guest at our sole discretion.
3.2 Online Ordering & Delivery
Rosto offers online ordering through our website and authorized third-party platforms (such as Toast). By placing an online order, you agree to the following:
All orders are subject to availability and confirmation.
Menu items, prices, and availability may change without prior notice.
You are responsible for providing accurate delivery address and contact information.
Delivery services may be fulfilled by third-party carriers; their terms and conditions also apply.
Orders cannot be cancelled once confirmed, except where required by law or at our discretion.
We reserve the right to refuse, cancel, or limit any order at our sole discretion.
Delivery times are estimates only and are not guaranteed. Rosto is not liable for delays caused by circumstances beyond our reasonable control.
3.3 Loyalty & Membership Program
Rosto may offer a loyalty or rewards program ("Loyalty Program"). Participation is subject to the following:
Enrollment requires creation of an account with accurate personal information.
Points, rewards, and benefits are non-transferable, have no cash value, and cannot be combined with other offers unless stated.
We reserve the right to modify, suspend, or terminate the Loyalty Program or any member's participation at any time without prior notice.
Rewards may expire if an account is inactive for 12 consecutive months.
Fraudulent activity, abuse of the program, or violation of these Terms may result in forfeiture of all points and termination of membership.
Rosto is not responsible for rewards lost due to account errors, unauthorized access, or technical issues outside our control.
3.4 Catering & Events
Rosto offers catering services for private and corporate events. Catering engagements are subject to the following:
All catering bookings require a signed catering agreement and a deposit as specified in your quote.
Cancellations must be made in writing. Deposits may be non-refundable depending on the notice provided and as outlined in your catering agreement.
Final guest counts and menu selections must be confirmed no later than 72 hours prior to the event unless otherwise agreed in writing.
Rosto is not liable for service disruptions caused by force majeure events, including but not limited to weather, supply chain disruptions, or public health emergencies.
Client is responsible for obtaining any permits or approvals required for the event venue.
4. User Accounts
Certain features of our Services, including online ordering and the Loyalty Program, may require you to create an account. You agree to:
Provide accurate, current, and complete registration information.
Maintain the confidentiality of your account credentials.
Notify us immediately of any unauthorized use of your account.
Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate your account if we suspect fraudulent activity, misuse of the Services, or violation of these Terms.
5. Payments & Pricing
All prices displayed on our website and ordering platforms are in U.S. Dollars and are subject to change without notice. Applicable taxes, fees, and delivery charges will be calculated and displayed at checkout.
Payments are processed securely through third-party payment processors (such as Toast). By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable amounts.
In the event of a pricing error, we reserve the right to cancel an order and issue a full refund. We will notify you promptly in such cases.
6. Refunds & Order Issues
We take pride in the quality of our food and service. If you experience an issue with your order, please contact us at info@rostochicken.com or call (201) 266-4052 within 24 hours of receiving your order.
Refunds or replacements are issued at our discretion and may be provided in the form of store credit, a replacement item, or a refund to the original payment method. We are not obligated to issue refunds for:
Change-of-mind cancellations after an order has been confirmed.
Issues resulting from inaccurate order information provided by the customer.
Dissatisfaction with customization choices made by the customer.
7. Intellectual Property
All content on the Rosto website and platforms, including but not limited to text, images, logos, graphics, menu designs, and branding, is the property of Rosto or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, publicly display, or create derivative works of any Rosto content without our express prior written consent. Unauthorized use of our intellectual property may violate copyright, trademark, and other applicable laws.
8. Prohibited Conduct
When using our Services, you agree not to:
Use the Services for any unlawful purpose or in violation of these Terms.
Impersonate any person or entity or misrepresent your affiliation.
Attempt to gain unauthorized access to our systems, accounts, or data.
Interfere with or disrupt the integrity or performance of the Services.
Use automated tools (bots, scrapers) to access or extract content from our website.
Post or transmit any harmful, offensive, or fraudulent content.
Abuse, harass, or threaten Rosto staff, delivery personnel, or other customers.
9. Third-Party Platforms & Links
Our website and ordering system may integrate with or contain links to third-party platforms, including Toast (online ordering), delivery services, and social media. Rosto is not responsible for the content, privacy practices, or availability of third-party platforms. Use of such platforms is governed by their own terms and policies.
10. Disclaimers & Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the fullest extent permitted by applicable law, Rosto and Cure Companies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, including but not limited to:
Loss of data, revenue, or business opportunity.
Food allergies or dietary reactions not disclosed to our staff at the time of ordering.
Delays or errors in online ordering or delivery.
Unauthorized access to your account.
Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to Rosto in the 30 days preceding the claim.
11. Food Allergens & Dietary Information
Rosto takes allergen awareness seriously. However, our kitchen handles a wide range of ingredients, and we cannot guarantee that any menu item is completely free from allergens. Cross-contamination is possible.
If you have a food allergy, intolerance, or dietary restriction, you must notify our staff at the time of ordering. By using our Services, you acknowledge that Rosto is not liable for allergic reactions or dietary issues resulting from failure to disclose relevant information prior to ordering.
12. Indemnification
You agree to indemnify, defend, and hold harmless Rosto, Cure Companies, and their respective officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
Your use of the Services.
Your violation of these Terms.
Your violation of any third-party rights.
Any content you submit or transmit through our platforms.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If the parties are unable to resolve the dispute informally within 30 days, the dispute shall be submitted to binding arbitration in Bergen County, New Jersey, in accordance with the rules of the American Arbitration Association (AAA).
You agree to waive any right to a jury trial or to participate in a class action lawsuit related to the Services.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in New Jersey to prevent irreparable harm.
14. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Where changes are material, we will provide reasonable notice via email, SMS, or website banner. Your continued use of our Services following any changes constitutes your acceptance of the revised Terms.
15. Termination
Rosto reserves the right to suspend or terminate your access to any part of the Services at any time, with or without cause or notice, including for violations of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination shall do so, including intellectual property rights, disclaimers, indemnification, and dispute resolution clauses.
16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rosto regarding the Services.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
Waiver: Failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Rosto.
